Chapter 16 - Uncovering The Rot Beneath The Scaffolding

On Monday morning, Marcus Vance called me into his office for an emergency evidentiary review that turned the entire filial responsibility lawsuit completely on its head. Marcus had engaged a forensic accounting specialist to audit the public financial disclosures, medical billing records, and banking records attached to Preston’s petition. As an engineer, I knew that whenever a structure fails mysteriously, the cause is almost never an external storm; it is almost always internal decay, corrosion hidden deep beneath the cosmetic paint.

"Harrison, take a look at these exhibits," Marcus said, sliding three thick stacks of financial spreadsheets across the polished glass desk. "Preston filed an affidavit claiming that Richard and Brenda were rendered completely destitute by medical expenses, leaving Richard with zero assets and requiring immediate court-mandated filial support from you. But when we subpoenaed the secondary banking records from Richard’s regional credit union, our forensic investigator discovered something extraordinary."

I scanned the rows of numbers, my engineering mind instantly categorizing the discrepancies in the cash-flow ledger. "These outflows aren't going to the medical center or the specialized rehabilitation clinic. Where is this money transferring?"

"Exactly," Marcus chuckled coldly, tapping a series of wire transfers highlighted in bright yellow ink. "Fourteen months ago, right after Richard suffered his stroke, Brenda granted Preston full durable power of attorney over their joint assets. Instead of putting Richard’s remaining pension and the lump-sum equity payout from their condo sale into a Medicaid-compliant special needs trust to cover his long-term care, Preston transferred over one hundred and eighty thousand dollars directly into a newly registered Delaware LLC titled 'Apex Heritage Brands'—a shell corporation registered under his own name."

The sheer depravity of it took my breath away. "He didn't lose their money in medical bills. He stole it."

"He embezzled it from his own incapacitated father," Marcus confirmed, his tone hardening into absolute legal severity. "Preston used eighty thousand dollars of that money to pay off his personal credit card debts, leased a high-end luxury SUV under the corporate name, and gambled away another forty thousand on speculative cryptocurrency derivatives. When the money ran dry and the nursing home threatened to evict Richard to a substandard state ward for non-payment, Preston realized he was facing catastrophic financial ruin and potential criminal charges for elder financial exploitation. So, he hired an aggressive probate lawyer on contingency, fabricated a narrative of sudden medical indigence, and filed this filial support suit against you to force you to replenish the accounts he had personally looted."

I closed the financial folder with a slow, deliberate snap. "Marcus, what are the legal ramifications of filing a fraudulent filial support petition supported by a perjured affidavit to conceal felony elder abuse?"

Marcus leaned back in his chair, a merciless glint in his eye. "In this state? It’s not just grounds for immediate dismissal of their petition with full prejudice and maximum financial sanctions. It is a direct referral to the State Attorney General’s Elder Protection Division for criminal prosecution. We aren't just defending a civil claim anymore, Harrison. We are holding the evidence that will put your brother in a state penitentiary."
